Ignite Phyzio & Sports Performance (“Ignite,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose and protect personal information through ignitephyzio.com, our online forms, emails and text messages, and our events and education programs, including The Athletic ACL and Office Hours (together, the “Services”). It also explains the choices and rights you have.

We apply the rights described in this policy to everyone who uses our Services, no matter which state you live in. Washington residents and others whose consumer health data we process should also read our Consumer Health Data Privacy Policy.

1. Information we collect

Information you give us

  • Identifiers and contact details: name, email address, phone number and mailing address.
  • Form responses: your role (for example athlete, parent or clinician), where you are in your recovery, questions and messages you send us, and event registrations.
  • Professional information: for clinicians and coaches, your profession, credentials or organization if you share them.
  • Purchase and transaction information: products, programs or courses you buy. Payment card details are collected and processed by our payment processors, not stored by us.
  • Communications: records of emails, texts, calls and messages with us.

Information collected automatically

  • Device and usage information: IP address, browser and device type, operating system, general location derived from IP address (not precise location), pages viewed, links clicked, referring website, and the date and time of visits.
  • Email and text engagement: whether you opened an email or clicked a link.
  • Cookies and similar technologies: see Section 4.

Information from others

  • Event and video conferencing platforms (such as Zoom) when you register for or attend a session.
  • Referral sources, such as a clinician or coach who refers you to us.
  • Social media platforms when you interact with our pages, subject to your settings on those platforms.

2. How we use information

  • Provide the Services, including registering you for events, sending links, reminders and recordings, and delivering programs or courses you request
  • Respond to questions and requests, including appointment and consultation requests
  • Send educational content, updates, newsletters and offers, where you have agreed to receive them
  • Understand how our Services are used and improve them
  • Measure the performance of our marketing
  • Protect the security of our Services, prevent fraud and abuse, and enforce our terms
  • Comply with legal obligations and respond to lawful requests

We will not use your personal information for purposes that are materially different from those described here without telling you and, where required by law, getting your consent.

3. How we disclose information

We do not sell your personal information for money. We do not disclose your personal information to third parties for their own marketing purposes. We disclose personal information only to:

  • Service providers and processors that act on our behalf under contracts that limit their use of the information, such as website hosting (Squarespace), customer relationship management and email (HubSpot), video conferencing (Zoom), scheduling, payment processing, cloud storage, and analytics providers.
  • Professional advisers such as lawyers, accountants and insurers, under confidentiality obligations.
  • Legal and safety recipients when we believe disclosure is required by law, subpoena or court order, or is necessary to protect the rights, property or safety of Ignite, our patients and clients, or others.
  • Business transfer recipients in connection with a merger, acquisition, financing or sale of all or part of our business, subject to this policy.
  • Others with your consent or at your direction.

4. Cookies, analytics and advertising

We and third parties use cookies, pixels, tags and similar technologies to operate our website, remember your preferences, understand how our Services are used, and measure and improve our marketing. Some of these technologies are provided by analytics and advertising companies (for example, Google or Meta), which may collect information about your activity on our website and across other websites over time.

Under some state laws, allowing these companies to collect information for advertising may be considered a “sale” or “sharing” of personal information or “targeted advertising.” You can opt out at any time:

  • Global Privacy Control: we treat a Global Privacy Control (GPC) signal from your browser as a valid request to opt out of the sale or sharing of your personal information and targeted advertising for that browser.
  • Email us at info@ignitephyzio.com with the subject line “Do Not Sell or Share My Personal Information.”
  • Browser settings: you can block or delete cookies, although some parts of the website may not work properly.

Do Not Track: because there is no common standard for browser “Do Not Track” signals, our website does not respond to them. We do honor Global Privacy Control signals as described above.

5. Health and other sensitive information

Some information you share with us, such as where you are in your ACL recovery or questions about your injury, may be considered health information or “sensitive” personal information under state law. We collect and use this information only with your consent or as needed to provide what you requested, and only for the purposes described in this policy. We do not sell health information, and we do not use it for targeted advertising.

Please don’t submit detailed medical information through our website forms. If you have a medical question, contact us to schedule an evaluation. Our free education sessions are for general education only, do not create a patient-provider relationship, and are not a substitute for individual medical advice.

6. Text messages

If you give us your mobile number, we may send text messages about events you have registered for, such as links and reminders. We will send marketing text messages only if you have separately agreed to receive them. Agreeing to receive marketing texts is never a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to any message to opt out, or HELP for help. We send texts only between 8 a.m. and 9 p.m. in your local time.

We do not sell, rent or share your mobile number or text-messaging consent with third parties or affiliates for their marketing purposes. Information is shared only with service providers that help us deliver messages.

7. Email

You can unsubscribe from marketing emails at any time using the link at the bottom of any marketing email. We will honor your request promptly. We may still send you transactional or relationship messages, such as registration confirmations, links to sessions you signed up for, or responses to your requests.

8. Your privacy rights

Depending on where you live, you may have some or all of the following rights. We honor these requests for all users, regardless of state, to the extent we reasonably can.

  • Know and access: confirm whether we process your personal information and get a copy of it, including the categories of information, sources, purposes and recipients.
  • Correct: ask us to fix inaccurate personal information.
  • Delete: ask us to delete personal information we collected from or about you, subject to legal exceptions.
  • Portability: receive your personal information in a portable, commonly used format.
  • Opt out: opt out of the sale or sharing of personal information, targeted advertising, and profiling that produces legal or similarly significant effects. We do not engage in that kind of profiling.
  • Limit or withdraw consent: limit the use of sensitive personal information or withdraw consent you previously gave, without affecting earlier processing.
  • Non-discrimination: we will not deny you services, charge different prices or provide a different level of service because you exercised your rights.

How to make a request

Email info@ignitephyzio.com or call 714-335-3182. Tell us what you are requesting and the email address or phone number you used with us. We will verify your request by matching information you provide with information we hold, and we may ask for more information if needed. We will not ask for more information than is necessary.

We will respond within 45 days. If we need more time, we may extend this by up to 45 more days and will tell you why. Requests are free, unless they are clearly unfounded or excessive.

Authorized agents: you may use an authorized agent to make a request. We may ask the agent for written proof of their authority and ask you to verify your identity directly.

Appeals: if we decline your request, you can appeal by replying to our decision or emailing info@ignitephyzio.com with the subject line “Privacy Appeal” within a reasonable time. We will respond in writing within 60 days and explain our decision. If you are not satisfied with the result, you may contact your state attorney general.

9. State-specific disclosures

California

This section supplements the policy for California residents, including under the California Consumer Privacy Act as amended (CCPA). In the last 12 months, we collected the categories of personal information below, from the sources described in Section 1, for the purposes described in Section 2.

We use sensitive personal information only for purposes permitted by the CCPA, such as providing the services you request. We do not knowingly sell or share the personal information of consumers under 16.

Shine the Light: California Civil Code section 1798.83 lets California residents ask whether we disclosed personal information to third parties for their direct marketing. We do not make these disclosures.

Nevada

We do not sell covered information as defined by Nevada law. Nevada residents may still submit an opt-out request to info@ignitephyzio.com.

Washington and other consumer health data laws

Our separate Consumer Health Data Privacy Policy describes how we handle consumer health data under Washington’s My Health My Data Act and similar laws in other states.

Other states

Residents of states with comprehensive privacy laws, including Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia, may exercise the rights in Section 8, including the right to appeal.

10. Children’s privacy

Our Services are not directed to children under 13, and we do not knowingly collect personal information online from children under 13. Because many of the athletes we work with are minors, we ask that a parent or guardian complete online forms and registrations for anyone under 18. If you believe a child under 13 has given us personal information, contact us and we will delete it.

11. Security and retention

We use reasonable administrative, technical and physical safeguards designed to protect personal information, and we require our service providers to do the same. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a data breach affects your personal information, we will notify you and the appropriate authorities as required by law.

We keep personal information only as long as reasonably necessary for the purposes described in this policy, such as maintaining our relationship with you and meeting legal, accounting and record-keeping requirements. Marketing contact information is kept until you unsubscribe or ask us to delete it. When information is no longer needed, we delete it or de-identify it.

12. Patient health records

If you become a patient, the health information in your treatment records is protected under applicable federal and state law, including the California Confidentiality of Medical Information Act, and is handled under our patient privacy practices rather than this website policy. Ask our front desk for a copy of our patient privacy notice.

13. Changes to this policy

We may update this policy from time to time. We will post the updated version on this page and change the “Last updated” date above. If we make material changes, we will give additional notice, such as a notice on our website or by email, and will get your consent where required by law.
